Section 02
Scope of these Terms
These Terms apply only to the public YRSE Website and publicly available content and resources made available through it.
Use of YRSE programmes by schools, teachers, administrators and students is governed by separate platform terms and, where applicable, agreements between YRSE and participating schools or organisations.
Nothing in these Terms replaces or changes a separate written agreement entered into with YRSE. If there is any conflict, the specific written agreement will take priority in relation to the matters it covers.
Section 03
Purpose of the Website
The Website provides information about YRSE and our programmes, including DriverReady and E-Mobility Education, together with information about road safety, research, policy, partnerships, news and related resources.
The Website is primarily intended to provide general information to schools, professionals, partners, funding partners, public bodies, parents, media and other interested visitors.
Information published on the Website does not by itself constitute an offer by YRSE to provide a programme, enter into a partnership, provide funding or enter into any other contractual relationship.
Section 04
Access to and availability of the Website
We may change, update, suspend, restrict, withdraw or discontinue any part of the Website or its content at any time.
We do not guarantee that:
- the Website or any content will always be available;
- access will be uninterrupted or error-free;
- defects will always be corrected immediately; or
- all content or functionality will remain available in its current form.
We may restrict or block access where reasonably necessary to protect YRSE, the Website, its systems, its intellectual property, other users or third parties. We are not obliged to continue providing the public Website or any particular public resource merely because it has previously been available.

Permitted use
You may use the Website for lawful personal, educational and professional purposes, subject to these Terms. You may:
- view publicly available pages;
- share links to publicly available pages;
- download or use resources where we expressly make them available for that purpose; and
- contact YRSE through the channels provided.
Any specific conditions accompanying a resource or publication also apply to its use.

Prohibited use
You must not:
- use the Website for any unlawful, fraudulent, abusive or harmful purpose;
- attempt to gain unauthorised access to the Website, its servers, databases, systems, accounts or data;
- interfere with, damage, disrupt or impair the Website, its security or its availability;
- introduce viruses, malicious code or other harmful technology;
- circumvent security, access-control or technical protection measures;
- impersonate YRSE, its personnel, a school, another organisation or another person;
- falsely imply that YRSE endorses, approves, sponsors or is affiliated with you, your organisation, product or service;
- harvest contact details or other information from the Website for unsolicited communications;
- systematically scrape, mine, extract, reproduce or harvest substantial quantities of Website content or data using automated means without our prior written permission, except to the extent permitted by law or for ordinary search-engine indexing;
- use Website content for commercial exploitation in a manner that infringes YRSE's intellectual property rights;
- remove copyright, trade mark or other proprietary notices; or
- encourage, assist or permit another person to do any of the above.

Intellectual property
Unless otherwise stated, YRSE owns or is authorised to use the copyright, trade marks and other intellectual property rights in the Website and its content. This includes, where applicable, YRSE branding, logos, original text, graphics, original educational materials, programme content and resources.
Access to the Website does not transfer any ownership or intellectual property rights to you. Unless expressly permitted by YRSE or by law, you must not:
- reproduce or republish substantial parts of the Website;
- modify YRSE materials and present them as YRSE materials;
- sell, license or commercially exploit YRSE content;
- create derivative commercial materials using protected YRSE content;
- use YRSE's name, logo or branding in a way that suggests endorsement, authorisation or partnership; or
- reproduce YRSE programme or teaching materials obtained from another source without the applicable permission.
Where YRSE expressly identifies a resource as available for public distribution, you may use and share it in accordance with any conditions stated on or with that resource. All rights not expressly granted are reserved.
Section 08
Linking to the Website
You may link to publicly available pages on the Website provided that the link is fair, lawful and does not:
- damage YRSE's reputation;
- misleadingly suggest association, approval, sponsorship or endorsement;
- present YRSE content as your own; or
- reproduce or frame the Website in a way that obscures its source.
We may ask you to remove a link where we reasonably consider that it breaches these Terms or misrepresents YRSE.
Section 09
Information submitted to YRSE
If you submit information through the Website, you are responsible for ensuring that, to the best of your knowledge, the information is accurate and that you are entitled to provide it. You must not knowingly submit unlawful, malicious, defamatory or infringing material.
The general Website enquiry channels are not intended for unsolicited confidential business proposals, commercially sensitive information or information that you do not have authority to disclose.
Unless YRSE has expressly agreed otherwise in writing before information is submitted, merely sending information through a general enquiry channel does not create a separate contractual duty of confidence beyond any duties that apply under law or under our Privacy Notice (opens in a new tab).
Section 10
Road safety, research and educational information
YRSE takes reasonable care in preparing information published on the Website. However, road laws, regulations, government guidance, statistics, research findings and official recommendations can change.
To the fullest extent permitted by law, we do not give any representation, warranty or guarantee that all Website content will at all times be complete, error-free, current, suitable for a particular person's circumstances or appropriate for use in every location or situation.
Website content is provided for general information and educational purposes. It is not a substitute for:
- legislation or the current Highway Code;
- official government, police, road authority or regulatory guidance;
- professional driving instruction;
- legal, medical or other professional advice; or
- an individual's responsibility to assess actual road conditions and act safely.
Where a decision depends on current law, guidance, statistics or professional advice, you should consult the current authoritative source. YRSE is not responsible for a person treating general Website content as personalised professional advice where it was not provided as such.
Section 11
Third-party information and links
The Website may refer or link to legislation, government agencies, research organisations, news publications, partners, funding partners and other third parties.
A link, reference or citation does not necessarily mean that YRSE controls the third party, endorses everything it publishes, guarantees its accuracy or availability, or accepts responsibility for its products, services, security or privacy practices. Third-party websites operate under their own terms and privacy practices.
Section 12
Enquiries about programmes and partnerships
Submitting an enquiry through the Website does not:
- enrol a school or student in a YRSE programme;
- guarantee programme availability;
- reserve programme capacity;
- create a partnership or funding commitment;
- constitute acceptance by YRSE of any proposal; or
- by itself create a contract with YRSE.
A contractual commitment arises only where YRSE enters into an applicable agreement or otherwise expressly confirms that commitment through an authorised process. YRSE may accept or decline an enquiry, programme request, proposed partnership or other opportunity at its discretion, subject to legal obligations and existing contractual commitments.
Section 13
Website security
We take reasonable measures to maintain the security of the Website, but no internet service can be guaranteed to be completely secure or free from defects, vulnerabilities or malicious software.
You are responsible for using appropriate security measures on devices and systems you use to access the Website. You must not misuse the Website by knowingly introducing malicious software or attempting to compromise its security.
Section 14
Liability
Nothing in these Terms excludes or restricts liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.
14.1 Business users
If you use the Website wholly or mainly for purposes connected with your trade, business, profession, school, public authority or organisation, then, to the fullest extent permitted by law, YRSE excludes all conditions, warranties, representations and other terms that might otherwise be implied in relation to the public Website or its content.
YRSE will not be liable for loss of profit, revenue, business, contracts or opportunities, anticipated savings, goodwill or reputation, loss or corruption of data, indirect or consequential loss, or loss arising from reliance on general Website information where current authoritative or professional guidance should reasonably have been obtained.
YRSE will not be liable for loss arising from temporary Website unavailability, changes to or withdrawal of Website content, events outside YRSE's reasonable control, or third-party websites, platforms or services that YRSE does not control, except to the extent that such liability cannot lawfully be excluded or limited.
14.2 Consumers
If you use the Website as a consumer, nothing in these Terms affects rights that the law gives you and that cannot be excluded or restricted. The Website is provided for general informational use. YRSE is not responsible for business losses suffered by a consumer arising from use of the public Website.
Section 15
Responsibility for serious business misuse
If you use the Website in the course of a business, profession, school, public authority or organisation and materially breach Sections 6 or 7, you will be responsible for reasonable losses, liabilities, claims and costs incurred by YRSE as a direct result of that breach.
This section does not apply to consumers acting wholly or mainly outside their trade, business, craft or profession.

Agreement to these Terms does not constitute consent to optional cookies, analytics or tracking technologies. Where consent is required, it will be requested separately through the Website's consent controls.
Section 17
Safeguarding and emergencies
The general Website and its contact facilities are not an emergency service. If someone is in immediate danger or urgent assistance is required, the appropriate emergency service or safeguarding authority should be contacted.
If information received by YRSE raises a genuine safeguarding concern, YRSE may take appropriate action and may share relevant information where necessary and lawful to protect a child or another person.

Section 18
Changes to these Terms
We may amend these Terms to reflect changes to the Website, YRSE's activities, our operating arrangements or applicable law. The current version will be published on the Website with its effective date.
Updated Terms apply to use of the Website from the date on which they are published. Changes to these Website Terms do not by themselves amend any separate written agreement that YRSE has entered into with a school, partner, funding partner or other organisation.
Section 19
Severability and waiver
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be treated as modified to the minimum extent necessary or, if necessary, removed. The remaining provisions will continue in effect.
If YRSE does not immediately enforce a right under these Terms, that does not mean that YRSE has waived that right.

Third-party rights
Except as expressly provided below, a person who is not a party to these Terms has no right to enforce them.
YRSE's directors, officers, employees and agents may rely on and enforce provisions of these Terms that expressly protect or limit liability in relation to them.
Section 21
Governing law and jurisdiction
These Terms and any dispute relating to the public Website are governed by the laws of England and Wales.
If you use the Website for business or professional purposes, the courts of England and Wales will have exclusive jurisdiction, subject to any mandatory legal rule that applies otherwise. If you are a consumer, you retain any mandatory rights you have to bring proceedings in the courts applicable to where you live.

Access from outside the United Kingdom
The Website may be accessible outside the United Kingdom. YRSE does not represent that Website content is appropriate for, or complies with the laws applicable in, every country or jurisdiction.
If you access the Website from another jurisdiction, you are responsible for complying with applicable local requirements to the extent that responsibility can lawfully be placed on you.
